To make this notice easy to find, we make it available on our homepage and at every point where personally identifiable information may be requested. Ascertain Screening and Investigations, LLC, through its normal course of business of pre-employment screening, is provided access to confidential information about consumers. This is obtained both from the consumer in the form of employment applications and signed consents/disclosures, as well as from third parties, including public records/court researchers, state departments of motor vehicles, major credit bureaus, previous employers and education institutions. The information we obtain is provided to our clients (prospective or current employers) under the permissible purpose of employment, as outlined in the Fair Credit Reporting Act. Prior to furnishing any information to a prospective or current employer, Ascertain first requires a signed agreement from the employer stating that the information is being used for employment purposes only, is being used according to the guidelines of the Fair Credit Reporting Act, and the laws of the European Union, and will not be used for any other purpose. Further, Ascertain first requires a signed consent from the consumer prior to commencing any background investigation on behalf of our client (the prospective or current employer).

Information Collected
The release and/or signed disclosure provided by the consumer to their prospective employer, along with the application for employment, contains personal information/identifying data that we use to request pertinent information which will be provided in a Consumer Report, or Investigative Consumer Report. Prior to beginning any background screening process, Ascertain first requires a copy of the consumer’s signed consent, which certifies their authorization to obtain this information on behalf of the employer. Information obtained may include current and past residence information, criminal records, motor vehicle records, consumer credit history, employment history, and education credentials. This information may be obtained via telephone, facsimile, email or U.S. mail and may include information about the consumer’s character, general reputation, personal characteristics and/or mode of living. All information gathered is then provided to the consumer’s current or prospective employer in the form of a Consumer Report or Investigative Consumer Report.

Consent of Consumer
The consumer’s signed consent form constitutes the authorization for Ascertain Screening to initiate the employment screening process on behalf of the prospective or current employer. If the consumer does not wish to have personal data made available to our client (their current or prospective employer), they should not sign the consent form and/or disclosure that is presented by the employer.
